The jury trial for a man accused of having sex with his underage babysitter is scheduled to begin Tuesday.
Dominic Fisher, 33, of Leesburg, faces two charges of sexual misconduct with a minor, both level 4 felonies. The charges stem from an alleged incident in 2015 when Fisher lived in Milford.
According to a probable cause affidavit from the Kosciusko’s County Prosecutor’s Office, police were dispatched on a call of sexual misconduct on May 24, 2015.
The teenage girl told the police that she had sex with Fisher on his pool table when she had come over to his house to babysit his children. She said he harassed to her to the point that she finally gave in and had sex with him, according to the affidavit.
The girl also told police she and Fisher had sex on the pool table a second time during spring break when Fisher’s wife and children were away.
Fisher told the police that nothing happened between him and the girl, the affidavit said.
Fisher’s wife told police that he admitted to her having sex with the girl on two occasions.
Fisher was arrested and booked in the Kosciusko County Jail in August 2015. He is currently out on a $15,000 bond.
A divorce is pending between Fisher and his wife, according to court records.
The trial is scheduled for two days in Kosciusko County Superior Court I with Judge David Cates presiding.
Fisher is represented by attorney Marielena Duerring, South Bend. Deputy Prosecuting Attorney Christanne Hampton will represent the state.
A level 4 felony is punishable by two to 12 years in prison and a $10,000 fine on each count.
