Argument leads to Warsaw man’s battery arrest

A Warsaw man is back in jail after two battery arrests within two weeks of each other.

According to the affidavit of probable cause filed by the Kosciusko County Prosecutor’s Office, on Jan. 3, Warsaw City police responded to a domestic abuse complaint at an apartment located on S. Union St. in Warsaw.

When the officer arrived he spoke Caleb M. DeVine, 24, of Warsaw, who said he and his girlfriend were arguing and he wanted to get his belongings from inside her apartment.

Police spoke to the girlfriend who said the two were verbally fighting when she told him to leave and if he didn’t she was going to call the police.

DeVine took her cell phone and threw it against the wall, breaking it. Then, he forced the victim down on the bed, grabbed her by the wrists and pinned her down.

As a result of her trying to escape, she received a scratch on her right forearm, a scratch on her leg and nearly hit her head on a rocking chair.

The victim’s young child was present in the home during the altercation.

DeVine is being charged with domestic battery with a child under 16 present, a level 6 felony; domestic battery, a class A misdemeanor which was enhanced due to DeVine’s 2015 conviction for domestic battery. DeVine was booked into jail Jan. 3, but shortly bonded out.

He was arrested again Jan. 16 for neglect of a dependent and battery with serious bodily injury of a child under 14 years old. Court documents have not been released yet for that arrest.

DeVine is currently being held in the Kosciusko County Jail on $20,250 bond from his most recent arrest.
