Battery Leads To Arrest and No Contact Order Against Winona Woman

WINONA LAKE – A Winona Lake woman was arrested Wednesday for battery with a child under 16 present, a level 6 felony, and domestic battery, a Class A misdemeanor.
Maria F. Marquez, 32, of 1202 Wooster Road, Lot 76, Winona Lake, was booked into the Kosciusko County Jail Tuesday on a $6,000 bond.
According to the probable cause affidavit filed by the Kosciusko County Prosecutor’s Office, on June 23 Warsaw Police Department officer Jamie De La Fuente responded to a domestic abuse complaint. De La Fuente spoke with Marquez, who stated she was in the process of picking up her children from her husband’s residence with whom she is currently separated and in the process of a divorce. While she was standing at the front door talking with him, he shut the door and she threw up her arm, striking her husband and causing a 2-1/2-inch bleeding scratch on his left arm.
De La Fuente spoke with the victim who stated Marquez was at his residence picking up their children. He attempted to close the front door so he could get the children ready to go when Marquez pushed the door open and entered the home uninvited. As a result, she caused a scratch on his arm. The victim told Marquez to leave and wait outside several times. He also provided a video of Marquez hitting him as she exited the home. The couple’s two children were present in the home when the incident occurred.
There is currently a protective order in place to prevent the victim from having any contact with Marquez. Marquez was in need of a babysitter and dropped the children off with the victim while she worked. A no contact order has been filed against Marquez from contacting the victim.
