Restaurant south of Fort Wayne suing state over mask mandate

(Network Indiana) — A barbeque restaurant in Bluffton is suing the Wells County Health Department, the state of Indiana, and Governor Eric Holcomb.

In August, the owner of Yergy’s State Road BBQ, Matt Yergler, made a social media post saying he would give employees and customers the option of wearing masks while inside.

While the support for the restaurant grew, the number of complaints also grew. That got the attention of the Wells County Health Department, which gave Yergy’s a verbal warning a cease-and-desist order. Yet, the restaurant refused to follow the mask mandate. The health department stepped in and shut them down.

Now Yergler is suing.

He says the closure put them on the brink of bankruptcy and deprived residents of “one of the best dining experiences in all of Indiana.” The lawsuit asks the court to vacate the health department’s order and find Holcomb’s executive orders “invalid.”
