Second Arrest Made In Warsaw Sex Case



A second arrest was made early Friday in a case of sexual misconduct with a minor and child solicitation. 
Brooke Sasha Natalie Espinoza, 23, of 525 Sophie Lane, Warsaw, was arrested at 3:02 a.m. for sexual misconduct with a minor at least 14-years old but less than 16. 
According to Kosciusko County officials, some time between April 15 and April 17, 2014, Espinoza did perform sexual acts with and solicit a 14-year old female to engage in sex acts. 
Joshua Kats, 24, of 1822 Sharon St., Warsaw, was arrested on the same charges May 18, 2015.
On March 19, 2015, Warsaw Police Department was notified by a Warsaw Community High School counselor that Kats and the 14-year-old female were involved in a sexual relationship. The female was interviewed by police at the Warsaw Department of Child Services office on April 2. She stated that she and Kats began having sex during her 2014 spring break, some time between April 8 and April 11. Kats allegedly knew that the victim was 14, according to the probable cause affidavit
Kats allegedly took off his and the victim’s clothes and proceeded to have sex with her, even though she said “no” several times. The following night, Kats took her to his residence and had sex again. She advised that by the third time they had sex, she was more willing and they continued to meet, having sex two or three times a day over the course of two weeks. She estimated that they had sex a total of 13 times. 
Kats then suggested to the victim that  he wanted to have a three-way sexual relationship with her and his girlfriend, Espinoza. The victim said that the three of them had sex April 18. 
WPD interviewed Kats on an unknown date where he admitted to kissing the victim and attempting to have sex with her. Police later contacted Espinoza on April 15, 2015. She told police that she knew Kats had contacted the victim in April 2014 while she was away on vacation. Espinoza said she did not know the exact age of the victim. She and Kats had agreed to have a three-way sexual relationship before they got married.
Police have been provided copies of text and Facebook messages sent from April 15 to April 17, 2014, between the three involved that supports the charges, according to the probable cause affidavit. In the messages, they talk about the sexual relationship and Espinoza’s concerns about the victim’s age.
Both Kats and Espinoza are being held at Kosciusko County Jail. An arrest report was filed May 18, 2015, for Kats. Espinoza has a bond of $15,250.
