According to the probable cause affidavit filed Thursday in Kosciusko Circuit Court, on March 14 a Milford police officer observed a black BMW traveling north in Ind. 15 at 80 mph in a 55 mph zone.

According to court papers, the officer attempted to make a traffic stop and reached speeds of 95 mph but was not gaining on the vehicle.

As the vehicle entered the city limits of Milford, the vehicle allegedly failed to signal before turning east on West Section Street, then traveled a short distance and turned north on Southwest Street and continued to flee at a high rate of speed, disregarding numerous stop signs and failing to signal turns before eventually coming to a stop.

Brace was identified as the driver and was immediately taken into custody, according to the affidavit.

Hilty was a passenger in the vehicle, according to court papers, and climbed over the center console to exit the vehicle and yelled at the officer.

She, too, was taken into custody.

As the vehicle was being prepared for impound, an inventory search was conducted. According to court papers, police located a clear plastic bowl and a cut red straw that field tested positive for methamphetamine on the floor where Hilty was sitting.

Both Hilty and Brace’s bonds were set at $5,250.
