Warsaw Man Faces Rapes Charges

A Warsaw man is facing charges after allegedly forcibly having sex with a female.

Ector Joel Rosales Urbina, 18, of 401 N. Washington St., Warsaw, is charged with two counts of rape, Level 3 felonies; strangulation, a Level 6 felony; intimidation, a Level 6 felony; and battery with moderate bodily injury, a Level 6 felony.

He was booked into the Kosciusko County Jail at 7:53 p.m. Monday on a $20,250 preliminary bond.

According to the probable cause affidavit, at about 2:18 a.m. Sunday, the Kosciusko County Communications Center dispatched officers to a reported rape. Upon arrival to the scene, the officer met with the victim who did not speak or understand English. The victim said she speaks and understands Spanish, so first responders used the Language Line translation service in order to communicate with her.

The victim said on Sunday she was asleep in her bed when she heard a knock on her door. She said she didn’t respond to the knock and instead got up to use the restroom. The victim said when she returned to her room, Rosales Urbina, also known as Hector Rosales, was in her room. The victim said Urbina was intoxicated and may have been high, according to court records.

The victim said she tried to get Urbina out of her room, but he refused until she sat down on the bed and gave him a hug. After the victim gave Urbina a hug, he pushed the victim down and got on top of her.

The victim started screaming and Urbina allegedly threatened to strangle her if she didn’t stop screaming. Urbina then forcibly had intercourse with the victim. He then started throwing up, which allowed the victim to get to her phone to call for help, according to court documents.

The victim was taken to the Fort Wayne Sexual Assault Treatment Center where a sexual assault kit was completed.

The victim’s mother told an officer she believed she knew where Urbina was located. The officer drove to the area and located a person matching Urbina’s description. Urbina said he was willing to make a statement to police.

Urbina allegedly admitted to being in the victim’s room Sunday morning. He knocked on the victim’s door and she let him in. He and the victim started making out on the bed. He then said he blacked out after this and couldn’t remember anything else.

Later in the interview, Urbina said at some point after making out, they were having sex. Urbina said at one point, the victim noticed he was drunk, so she asked him to stop. He said he stopped, grabbed his clothes and exited her room.

When Urbina was asked how much alcohol he had consumed, he said he drank a quarter of a bottle of Hennessy and 10 beers. He said he started consuming alcohol about 6 p.m. Saturday and got to the residence a little after midnight Sunday.
