Family Of Edith Schmucker May Sue For Wrongful Death

ELKHART COUNTY – Court records filed in Elkhart Circuit Court indicate family members of Edith Schmucker may sue for her wrongful death.

Schmucker died Aug. 3 after a two-vehicle crash on Ind. 19 in Elkhart County. The other three people killed in the crash included U.S. Rep. Jackie Walorski and two of her staff members, Emma Thomson and Zachery Potts. Schmucker was the sole occupant of her vehicle and Potts was driving the vehicle with him, Thomson and Walorski.

The court order, filed Aug. 15 and signed by Elkhart Circuit Court Judge Michael A. Christofeno, states the heir entitled to receive the proceeds of the wrongful death action is Edith’s 17-year-old son.

It also states, “It is therefore ordered, adjudged and decreed by the court that Vincent Renze and Erica A. Miller should be appointed the special administrators of the estate of Edith Jo Schmucker for the sole purpose of bringing an action concerning the decendent’s alleged wrongful death.”

No lawsuit has been filed as of Tuesday.
